Drug Courts and Proposition 36

A recent California law creates a provision that sends drug offenders to a treatment facility rather than to a prison. This law is an attempt to recognize that when a drug offender is sent to prison for something relatively minor, they frequently come out a worse criminal than they went in. Recognizing this, a court will hold a hearing determining your suitability for a drug treatment program. People charged with a violent drug crime, or the sale or manufacture of an illegal drug are not eligible for this diversionary proceeding.
