Four judges appointed to Santa Clara judiciary

Four new judges were appointed to the Santa Clara judiciary this week by Gov. Arnold Schwarzenegger.

On Monday, the Gov. Schwarzenegger named deputy public defender Andrea Flint, Palo Alto lawyer Thomas Kuhnle, Saratoga lawyer James Stoelker and San Jose lawyer Drew Takaichi as Superior Court judges.

The governor has been moving to fill empty judgeships before he leaves office in January, a tradition for outgoing governors who do not want to let their successors make the appointments.

Flint, 40, has been a deputy public defender since 1997, most recently supervising her office’s juvenile justice division. McCracken, 49, was a supervisor under outgoing District Attorney Dolores Carr.

The other two appointees have civil law backgrounds. They are all Democrats.

Alleged bank robber nabbed by San Jose police

A 44-year-old Milpitas man was arrested in San Pablo a few hours after San Jose police say he robbed a bank.

He was arrested in connection with a noon-time robbery of the Bank of America on the 2600 block of N. First Street in San Jose. According to the teller, he handed her a note with his demands on it and then left with undisclosed amount of cash.

Authorities developed leads on where he might have gone, and through cooperation with the San Pablo and Kensington police departments, were able to locate him inside a gambling casino.

Fatal shooting in East San Jose

According to San Jose police, a 40-year old man was fatally shot Thursday night in the East San Jose area.

The incident occurred on the 1600 block of Bermuda Way around midnight and was the city’s 20th homicide for this year.

Officers responding to reports of gunfire found the man in front of a home with a gunshot wound. He was taken to a nearby hospital but pronounced dead on arrival.

Police believe the shooting may be gang-related and are seeking a suspect.

Vietnamese Anti-Communism Activist Packs Courtroom

Vietnamese “freedom fighter” Ly Tong is accused of, “four felony counts, including burglary and the unauthorized use of a tear gas, and one misdemeanor — resisting arrest in connection with Sunday’s attack,” according to the Mercury News.

Long allegedly dressed up like woman and pretended to give a flower to Vietnamese pop star, Dam Vinh Hung, then sprayed him with pepper spray. Hung is considered to be the poster child for Vietnam’s communist government. Tong is an avid anti-communism leader.

The courtroom was packed Wednesday in San Jose as his followers gathered to support him.

Apple employee uses app to track down stolen goods

On Monday, June 21, an Apple employee was contacted at work and informed that his downtown home in San Jose had been burglarized. The thieves took over $20,000 in computer products, including two iPads. When the victim was notified, he immediately contacted the San Jose police department and informed them that he could track down the burglars using the GPS application installed on the Apple iPads.

Having used this feature previously to locate an iPhone that had been lost between couch cushions, the victim quickly enabled the app and watched the burglars drive through town. When their vehicle stopped on a cul de sac, police took action and arrested the suspects, who had compiled a backseat full of expensive computer equipment. Stolen goods were returned to their owners through serial number look ups and registration information.

Twenty-year-old Murdered in San Jose Wednesday

A 20-year-old man was murdered in San Jose Wednesday. According to police reports, the San Jose murder may have been related to gang violence.

The victim apparently was approached by two males who stabbed and shot the man multiple times. At this time, police are still investigating the murder and searching for suspects.

Probe Alleges San Jose Police Officers Repeatedly Used Excessive Force

An investigation by Mercury News alleges that more than a dozen San Jose police officers repeatedly used force when arresting individuals over the past year. In the probe conducted by the newspaper, a review showed that there were 321 instances of force used by San Jose police officers in which the paperwork stated that the suspect was "resisting arrest". Some individuals claim that the resisting arrest tag is often used as justification for the use of force.

The review submitted by the newspaper also revealed 19 cases in which legal motions were filed against San Jose officers. The motions name 42 officers and claim they used excessive force during the arrest process.

Kidnapper sentenced to nine years in prison

Judge
James Ellis issued a nine-year sentence Tuesday for a 23-year-old man
who was arrested on kidnapping charges in April 2007. The kidnapper,
Saul Davila, admitted that he helped in a 2007 kidnapping of a man who
owned a chain of small markets in South Bay. 

When
Davila and the co-kidnapper were arrested in 2007, both men faced
multiple felony charges and the possibility of life in prison. Davila,
however, agreed to plea no contest to felony kidnapping with the use of
a gun and to testify against the co-kidnapper, 43-year-old Arnulfo Barajas Loza .

As
part of the deal with the San Jose District Attorney, Davila agreed to
a sentence of no more than 12 years in prison, which Judge Ellis
shortened to nine years Tuesday. Loza also agreed to a plea deal in
April and was sentenced to 16 years in prison.

San Jose Task Force Investigating Public Intoxication Solution

A task force was appointed to study the rate and high number of public intoxication arrests and incidents in San Jose. City officials believe that the number for the city is very high, and the city has been looking for an effective way to address this issue.

The city is now considering a new program that would detain individuals in jail without charging them with a public intoxication.  The new model may detain individuals who are drunk in public, place them in jail until they sober up, and then let them go free without criminal charges.  This may allow many individuals to avoid having a criminal record for a drunken mistake.  More details on this plan and its implementation should be known in the future.

Couple Arrested for Suspected Shoplifting

A San Jose couple was arrested on suspicion of robbery.  The couple allegedly shoplifted clothing and merchandise from a Kohl’s department store.  Aside from shoplifting charges, however, the husband may likely face assault charges, as he assaulted police officer who approached him and his wife.

Although the couple fled the department store, San Jose police officers’ follow-up investigation led them to find the names and addresses of the couple.  Additionally, officers obtained a search warrant to search the couple’s home for evidence related to the robbery.
