Two People Charged with DUIs at Golf Course

Posted on February 7th, 2011 No Comments

A man and woman were arrested in Palo Alto after allegedly causing three hit and run car accidents at a golf course. The first accident occurred when the man’s Toyota Camry allegedly hit a parked vehicle.

Two accidents followed, as it was reported that shortly after leaving the golf course, the man hit two other vehicles as they were driving down a nearby street. The license plate number was a match for the Toyota Camry that was involved in the earlier incident.

The woman involved was found behind the wheel of a separate vehicle and, according to police, was intoxicated and, consequently, arrested. Her male companion was also arrested on charges of a DUI.

A 43-year-old San Francisco man has pleaded “not guilty” to charges of assault against a Jesuit priest. The man allegedly came to the 65-year-old preist’s retirement home and beat him until he was bloody in front of other residents.

The man had claimed that the priest had molested him and his younger brother during a 1975 camping trip, and that he wanted to take the case to trial in order to raise public awareness about abuse by the clergymen and to expose the alleged molestation.

Four judges appointed to Santa Clara judiciary

Posted on December 14th, 2010 No Comments

Four new judges were appointed to the Santa Clara judiciary this week by Gov. Arnold Schwarzenegger.

On Monday, the Gov. Schwarzenegger named deputy public defender Andrea Flint, Palo Alto lawyer Thomas Kuhnle, Saratoga lawyer James Stoelker and San Jose lawyer Drew Takaichi as Superior Court judges.

The governor has been moving to fill empty judgeships before he leaves office in January, a tradition for outgoing governors who do not want to let their successors make the appointments.

Flint, 40, has been a deputy public defender since 1997, most recently supervising her office’s juvenile justice division. McCracken, 49, was a supervisor under outgoing District Attorney Dolores Carr.

The other two appointees have civil law backgrounds. They are all Democrats.

San Jose Named No.4 Safest City

Posted on November 24th, 2010 No Comments

San Jose was named the third safest city in America this year, according to a report from CQ Press published Monday.

The report is based on FBI crime statistics for 2009 for cities with a population of 500,000 or more. San Jose was named the safest city in America in 2006 but has been No. 4 for a steady 3 years now. El Paso, Honolulu, and New York City were the top three safest cities.

“Although we are the fourth safest city in America we are still very proud of that ranking and proud of our crime reduction efforts,” Acting Police Chief Chris Moore said. “We will do our best to maintain that ranking.”

Man charged with beating priest seeks publicity for priest’s crimes

Posted on November 15th, 2010 No Comments

A Bay Area man who appeared in court Friday on charges that he beat his former priest is hoping to use the publicity to put the spotlight on Father Jerry Lindner, who he says abused children for years.

William Lynch is accused of viciously beating the former priest earlier this year. Two dozen protesters appeared outside the courtroom Friday to make it clear that they supported Lynch’s actions and wanted to use the trial as a chance to publicize Lindner’s sexual abuse of children.

“He raped his nieces and nephews, he raped Will, he raped Bart, he raped Deb and he raped Crista,” said Lynch family friend Christina Smith. “Why isn’t he in jail?”

Prosecutors say that Lynch premeditated the attack on Lindner and threatened to kill him on 911 tapes. Deputy district attorney Vicki Gemetti said of the attack, “We believe that our laws exist to protect all members of society, irrespective of who the victim is.”

Apple employee uses app to track down stolen goods

Posted on June 25th, 2010 No Comments

On Monday, June 21, an Apple employee was contacted at work and informed that his downtown home in San Jose had been burglarized. The thieves took over $20,000 in computer products, including two iPads. When the victim was notified, he immediately contacted the San Jose police department and informed them that he could track down the burglars using the GPS application installed on the Apple iPads.

Having used this feature previously to locate an iPhone that had been lost between couch cushions, the victim quickly enabled the app and watched the burglars drive through town. When their vehicle stopped on a cul de sac, police took action and arrested the suspects, who had compiled a backseat full of expensive computer equipment. Stolen goods were returned to their owners through serial number look ups and registration information.

How is a grand jury critical to your criminal case?

Posted on January 4th, 2010 No Comments

Before going to trial, a federal case will first be tried in front of a grand jury. The purpose of the grand jury is to determine whether there is enough evidence for a trial.

This determination is made after the grand jury meets with the prosecutor and examines the evidence. If the grand jury believes tha case should go to trial, it will often issue an indictment or take other steps to send the case to trial.

If your case is about to go before a grand jury, contact the San Jose federal criminal lawyer Daniel Jensen, P.C., at 408-296-4100.
