Four judges appointed to Santa Clara judiciary

Four new judges were appointed to the Santa Clara judiciary this week by Gov. Arnold Schwarzenegger.

On Monday, the Gov. Schwarzenegger named deputy public defender Andrea Flint, Palo Alto lawyer Thomas Kuhnle, Saratoga lawyer James Stoelker and San Jose lawyer Drew Takaichi as Superior Court judges.

The governor has been moving to fill empty judgeships before he leaves office in January, a tradition for outgoing governors who do not want to let their successors make the appointments.

Flint, 40, has been a deputy public defender since 1997, most recently supervising her office’s juvenile justice division. McCracken, 49, was a supervisor under outgoing District Attorney Dolores Carr.

The other two appointees have civil law backgrounds. They are all Democrats.

San Jose man charged with involuntary manslaughter for stabbing death

A San Jose man was charged with voluntary manslaugthter as part of a fatal stabbing case. According to police reports, the stabbing behind a radio station last week. 

If the man is convicted, he could receive 12 years in prison. The stabbing allegedly occurred as a result of a fight between the alleged stabber and the victim.

Suspects in ID thefts case brought into custody

A Scotts Valley couple has been brought into custody on charges of
identification theft.

According to Santa Clara County
Sheriff's Department, the investigation began when one suspect's
roommate called police to report stolen property. The deputy
eventually found stolen materials, a bag of stolen mail, and a truck
that had been involved in an earlier hit-and-run accident. The county
judge issued a warrant for the arrest of the suspect, although he had
already been detained for passing a bad check in Sunnyville. His
girlfriend fled the scene, leading police on a chase all the way to
San Francisco, where she was eventually stopped and arrested.

On Monday, the suspect was held in
the county jail with charges of forgery, identity theft, and

Teenage woman killed in San Jose shooting

A 19-year-old woman was shot and killed Sunday. According to police reports, the shooting occurred in San Jose near William Street. 

The woman apparently was standing in front of a restaurant when she was shot. The woman was then taken to a nearby hospital, where she was later pronounced dead. At this time, police are still investigating the shooting.

San Jose man dies while under police custody

A San Jose man died in police headquarters last Friday. According to police reports, the man was arrested on suspicion of driving a stolen car. 

While the man was being booked, the man fainted. When medical officials arrived, they took the man to a local hospital, where he was later pronounced dead.

San Jose Police Department may face audit for excessive force

The San Jose Police Department may come under review for its use of force in resisting-arrest cases. The review has been requested by two South Bay assemblymen. 

The review would be performed by the State Auditor Elaine Howle. It would include an audit to determine if officers are properly trained and whether the department correctly tracks complaints of excessive force.

Probe Alleges San Jose Police Officers Repeatedly Used Excessive Force

An investigation by Mercury News alleges that more than a dozen San Jose police officers repeatedly used force when arresting individuals over the past year. In the probe conducted by the newspaper, a review showed that there were 321 instances of force used by San Jose police officers in which the paperwork stated that the suspect was "resisting arrest". Some individuals claim that the resisting arrest tag is often used as justification for the use of force.

The review submitted by the newspaper also revealed 19 cases in which legal motions were filed against San Jose officers. The motions name 42 officers and claim they used excessive force during the arrest process.

San Jose police to begin wearing head-mounted cameras

Some San Jose police will begin wearing head-mounted cameras. According to news reports, the cameras will make visual and audio recordings of police interactions with civilians. 

The recrodings will send digital transmissions to a central server. The recordings will not only serve as a way to collect evidence but also for the officer's safety.
