A Santa Barbara judge has thrown out the drunk driving case against Santa Barbara News-Press investigative journalist Peter Lance.
Lance was pulled over on New Year’s Eve on suspicion of drunk driving. The judge ruled that the officer did not have a probable cause for pulling him over, which makes evidence presented in court against the defendant unusable.
According to the officer’s testimony, Lance was stopped at a green light for several seconds, looking down at his lap. When she shined her flashlight into the car, he looked up and waited before he started driving. She pulled him over a block later. A breathalyzer test showed his blood alcohol level was 0.09, just above the legal limit of 0.08, but Lance says the officer held the breathalyzer, causing it to be inaccurate.
