Drugged driving on the rise

Drunk driving fatalities in the state of California are declining, but crashes involving motorists on prescription and illegal drugs are on the rise.

According to the California Office of Traffic Safety, 30 percent of drivers killed in 2010 tested positive for legal and/or illegal drugs. Officials say that driving while on drugs, legal or not, can be just as dangerous as driving while under the influence of alcohol. Most accidents involving drugs go unreported due to the high costs of toxicology tests.

The California Highway Patrol has teamed up with the Office of Traffic Safety to help spot drugged drivers. The agency is unsure as to why the number of drugged drivers have increased over the years, but the legalization of marijuana may be a factor.

Mother accused of attempted murder

A 42 year-old San Jose mother is being accused of being the getaway driver for her 14 year-old son and his 17 year-old friend while they stabbed another teenager. The Santa Clara County District Attorney’s Office has charged her with attempted murder.

Prosecutors believe the teens were motivated to stab the other teen because he was in a rival gang. If the mother is convicted of gang enhancement, she could spend 19 years in prison.

According to the injured teen, a SUV driven by a woman followed him and then two teenage boys came out and stabbed him. He said he heard the woman tell them to leave and then drove away.

San Jose nightclub owner accused of rape

The owner of two San Jose nightclubs has been accused of raping a young woman in his home earlier this year.

According to his lawyer, the man plans to plead not guilty. Court documents reveal that the woman behind the accusations claim that she came to his home after spending the evening at one of his night clubs, believing there was going to be a small get together.

Instead, only his family was at his home. She went to bed in a guest bedroom and awoke to him taking off her clothes and then proceeding to rape her. The man is facing felony charges of rape by force or violence. He is currently out on bail.

Eight Navy sailors discharged for assault, hazing

The Navy has discharged eight sailors after video of them choking another sailor on board a San Diego-based assault ship surfaced.

The sailors allegedly involved in the choking and assault were doing it as an initiation rite. All eight received general discharges following the captain’s proceedings. Although the discharge can be appealed, none of the accused have done so.

An investigation into the incident, which took place in early January, included testimony and statements from the sailors that were considered to be the equivalent to confessions. This hazing incident comes in the wake of criminal proceedings against three Marines accused of assaulting another Marine in Afghanistan for several hours, leading to his suicide.

Mother pleads not guilty to vehicular homicide

A Southern California mother plead not guilty to charges of vehicular manslaughter with gross negligence earlier this week. Last April the woman was involved in a fatal car accident that killed a 23 year-old woman.

According to prosecutors, the woman was so distracted while driving on Interstate 405 that she failed to notice that traffic had stopped for several seconds. They claim she continued to drive at 80 mph, causing her to rear-end another vehicle, killing the driver.

The woman claims that it was simply an accident. So far the District Attorney has not been able to prove whether she was texting or doing something else on her phone when the crash occurred.

SF sheriff pleads not guilty to domestic violence charge

Recently sworn in San Francisco Sheriff Ross Mirkarimi pleaded not guilty this week to charges of domestic violence.

Despite his not guilty plea and his wife’s urging that he was not a threat to her or their child, the judge issued Mirkarimi a stay away order from his family while the case is open. The sheriff is accused of domestic violence, child endangerment, and dissuading a witness all stemming from an alleged incident that occurred between him and his wife on New Year’s Eve.

According to the couple’s neighbor, the wife came to her house the day after the incident occurred. The neighbor claims that Mirkarimi’s wife told her that Mr. Mirkarimi bruised her arm during an argument.

Former SBPD supervisor charged with embezzlement

A former Santa Barbara Police Department supervisor is accused of embezzling nearly $200,000 from parking citation coffers and city revenues.

The woman was arrested last August and was then believed to have stolen $100,000, but new evidence allegedly shows that it was twice that amount. The Deputy District Attorney believes the former supervisor’s embezzlement scheme began in 2006 and continued until the day she was arrested.

She has been charged with grand theft embezzlement and four counts of destroying parking citations. The woman had been a city employee for nearly 22 years and originally worked with the city to investigate misappropriated funds. She is scheduled to appear in court next month.

U.S. Marshals arrest man accused of molestation

An alleged 27 year-old child molester was arrested by U.S. Marshals in Bakersfield last week.

The man is accused of molesting a 13 year-old girl in Kelso, Washtingon in 2008. The then 24 year-old was working as a street sweeper when, according to court documents, he molested the daughter of a friend in their home. Her mother called the police after discovering the incident, but the man was no longer in the Kelso area.

U.S. Marshals received a tip after the man was featured on the television show “America’s Most Wanted.” Officers arrested the man last Thursday without incident.

Teens plead not guilty to attempted murder

Three teenagers pleaded not guilty last week to charges of attempted murder of a Redwood City man.

The teens, ranging in age from 18 to 19 years-old, are believed to have attacked the man on December 13 on behalf of a street gang. All three are charged with attempted murder, being an accessory to a felony, and acting to further street gang activities. A fourth teenager is awaiting transfer from Anaheim before he announces his plea.

Witnesses say they saw four teenagers exit a gold car and stab a man several times in his stomach around 4:30 pm and then run away. The victim is currently in critical condition.

Mother’s murder charge dismissed

The murder charges brought against a Loleta mother have been dropped by a Humboldt County judge.

The 27 year-old woman was charged with murdering her six week-old son when she breastfed him after smoking methamphetamine. She took her son to the hospital after he stopped breathing in November 2010; his cause of death was methamphetamine toxicity. The judge states there was no evidence in the preliminary hearing to rule that the mother knowingly meant to endanger her son’s life.

The mother originally faced charges of involuntary manslaughter before the case was refiled as murder. A Humboldt County Deputy District Attorney said he may decide to refile a murder charge and start the case over again.
